The Book of Transactions

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ‏".
If anyone buys palm-trees after they have been fecundated the fruit belongs to the seller unless the buyer makes a proviso.
Narrated by Ibn Umar (Allah be pleased with them) reported Allah's Messenger (ﷺ) as saying:

Ibn Umar reports that the Prophet Muhammad (ﷺ) stated a clear guideline regarding the sale of palm trees that have been fertilized. The seller retains the rights to the fruit unless the buyer stipulates otherwise. ۞ وَهُوَ ٱلَّذِىٓ أَنشَأَ جَنَّٰتٍۢ مَّعْرُوشَٰتٍۢ وَغَيْرَ مَعْرُوشَٰتٍۢ وَٱلنَّخْلَ وَٱلزَّرْعَ مُخْتَلِفًا أُكُلُهُۥ وَٱلزَّيْتُونَ وَٱلرُّمَّانَ مُتَشَٰبِهًۭا وَغَيْرَ مُتَشَٰبِهٍۢ ۚ كُلُوا۟ مِن ثَمَرِهِۦٓ إِذَآ أَثْمَرَ وَءَاتُوا۟ حَقَّهُۥ يَوْمَ حَصَادِهِۦ ۖ وَلَا تُسْرِفُوٓا۟ ۚ إِنَّهُۥ لَا يُحِبُّ ٱلْمُسْرِفِينَ
And He it is who causes gardens to grow, [both] trellised and untrellised, and palm trees and crops of different [kinds of] food and olives and pomegranates, similar and dissimilar. Eat of [each of] its fruit when it yields and give its due [zakah] on the day of its harvest. And be not excessive. Indeed, He does not like those who commit excess.
