Context
In this hadith, a woman accidentally killed her pregnant co-wife by throwing a rock at her. The Prophet Muhammad ﷺ ruled that the compensation for the unborn child would be a slave, while the woman's family would be responsible for her blood money. This situation highlights the complexities of justice and accountability in cases of accidental harm, emphasizing the need for fair compensation.
Modern Application
In today's society, this principle can be seen in discussions around accountability and restitution for accidents. It encourages individuals to take responsibility for their actions and consider the impact on others, particularly in cases where harm is unintentional.
Topics
This hadith is tagged with Blood Money and Punishments (Hudud) because it addresses the consequences of accidental killing and the required compensation.
And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charity. But if the deceased was from a people at war with you and he was a believer - then [only] the freeing of a believing slave; and if he was from a people with whom you have a treaty - then a compensation payment presented to his family and the freeing of a believing slave. And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.
O you who have believed, prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment.
And they both raced to the door, and she tore his shirt from the back, and they found her husband at the door. She said, "What is the recompense of one who intended evil for your wife but that he be imprisoned or a painful punishment?"
Lodge them [in a section] of where you dwell out of your means and do not harm them in order to oppress them. And if they should be pregnant, then spend on them until they give birth. And if they breastfeed for you, then give them their payment and confer among yourselves in the acceptable way; but if you are in discord, then there may breastfeed for the father another woman.
