حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ، وَسَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيُّ الْمَعْنَى الْوَاحِدُ، قَالاَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ، وَعَنْ مُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ، يُحَدِّثَانِ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّ أَبَاهُ، نَحَلَ ابْنًا لَهُ غُلاَمًا فَأَتَى النَّبِيَّ صلى الله عليه وسلم يُشْهِدُهُ فَقَالَ ‏"‏ أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ مَا نَحَلْتَ هَذَا ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَارْدُدْهُ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ يَسْتَحِبُّونَ التَّسْوِيَةَ بَيْنَ الْوَلَدِ حَتَّى قَالَ بَعْضُهُمْ يُسَوِّي بَيْنَ وَلَدِهِ حَتَّى فِي الْقُبْلَةِ ‏.‏ وَقَالَ بَعْضُهُمْ يُسَوِّي بَيْنَ وَلَدِهِ فِي النُّحْلِ وَالْعَطِيَّةِ الذَّكَرُ وَالأُنْثَى سَوَاءٌ ‏.‏ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ ‏.‏ وَقَالَ بَعْضُهُمُ التَّسْوِيَةُ بَيْنَ الْوَلَدِ أَنْ يُعْطَى الذَّكَرُ مِثْلَ حَظِّ الأُنْثَيَيْنِ مِثْلَ قِسْمَةِ الْمِيرَاثِ ‏.‏ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ ‏.‏

That his father gave a slave to a son of his. So he went to the Prophet (ﷺ) to have him witness it. He (ﷺ) said: 'Have you given a gift similar to this one to all of your sons?' He replied: 'No'. So he said: 'Then take him back.'"

ٱرْجِعُوٓا۟ إِلَىٰٓ أَبِيكُمْ فَقُولُوا۟ يَٰٓأَبَانَآ إِنَّ ٱبْنَكَ سَرَقَ وَمَا شَهِدْنَآ إِلَّا بِمَا عَلِمْنَا وَمَا كُنَّا لِلْغَيْبِ حَٰفِظِينَ

Return to your father and say, "O our father, indeed your son has stolen, and we did not testify except to what we knew. And we were not witnesses of the unseen,

قَالُوا۟ يَٰٓأَيُّهَا ٱلْعَزِيزُ إِنَّ لَهُۥٓ أَبًۭا شَيْخًۭا كَبِيرًۭا فَخُذْ أَحَدَنَا مَكَانَهُۥٓ ۖ إِنَّا نَرَىٰكَ مِنَ ٱلْمُحْسِنِينَ

They said, "O 'Azeez, indeed he has a father [who is] an old man, so take one of us in place of him. Indeed, we see you as a doer of good."

فَلَمَّا رَجَعُوٓا۟ إِلَىٰٓ أَبِيهِمْ قَالُوا۟ يَٰٓأَبَانَا مُنِعَ مِنَّا ٱلْكَيْلُ فَأَرْسِلْ مَعَنَآ أَخَانَا نَكْتَلْ وَإِنَّا لَهُۥ لَحَٰفِظُونَ

So when they returned to their father, they said, "O our father, [further] measure has been denied to us, so send with us our brother [that] we will be given measure. And indeed, we will be his guardians."

قَالَ هَلْ ءَامَنُكُمْ عَلَيْهِ إِلَّا كَمَآ أَمِنتُكُمْ عَلَىٰٓ أَخِيهِ مِن قَبْلُ ۖ فَٱللَّهُ خَيْرٌ حَٰفِظًۭا ۖ وَهُوَ أَرْحَمُ ٱلرَّٰحِمِينَ

He said, "Should I entrust you with him except [under coercion] as I entrusted you with his brother before? But Allah is the best guardian, and He is the most merciful of the merciful."

سُورَةُ النِّسَاءِ

An-Nisaa (The Women)

بِسْمِ ٱللَّهِ ٱلرَّحْمَـٰنِ ٱلرَّحِيمِ

وَإِنْ أَرَدتُّمُ ٱسْتِبْدَالَ زَوْجٍۢ مَّكَانَ زَوْجٍۢ وَءَاتَيْتُمْ إِحْدَىٰهُنَّ قِنطَارًۭا فَلَا تَأْخُذُوا۟ مِنْهُ شَيْـًٔا ۚ أَتَأْخُذُونَهُۥ بُهْتَٰنًۭا وَإِثْمًۭا مُّبِينًۭا

But if you want to replace one wife with another and you have given one of them a great amount [in gifts], do not take [back] from it anything. Would you take it in injustice and manifest sin?
