And when the division of the inheritance is attended by kinsmen those of kinship who cannot inherit and orphans and the poor grant them something out of it before the division is effected; and if the inheritors are young speak to them O guardians honourable words kindly by apologising to them that it is not your possession to divide as you wish but that it is for the young inheritors. Some say that this stipulation was abrogated; others say that it was not only that people were all too readily neglecting it since it was encouraged but not prescribed. According to Ibn ‘Abbās however it is a duty.

Ibn `Abbas said ( regarding the verse), "And when the relatives and the orphans and the poor are present at the time of division, "this verse and its order is valid and not abrogated."

Some people claim that the order in the above Verse is cancelled, by Allah, it is not cancelled, but the people have stopped acting on it. There are two kinds of guardians (who are in charge of the inheritance): One is that who inherits; such a person should give (of what he inherits to the relatives, the orphans and the needy, etc.), the other is that who does not inherit (e.g. the guardian of the orphans): such a person should speak kindly and say (to those who are present at the time of distribution), "I can not give it to you (as the wealth belongs to the orphans).

Jami` at-Tirmidhi #641Amr bin Shu'aib narrated from his father, from his grandfather that :Sahih

the Prophet addressed the people and said: "As for one who is the guardian of an orphan who has wealth, then let him do business with it and not leave it until it becomes consumed by charity."

Sunan Abu Dawud #1694Anas reported the Messenger of Allah (ﷺ) as saying :Sahih

Anyone who is pleased that his sustenance is expanded and his age extended should do kindness to his near relatives.

Sahih Muslim #7339Hisham reported on the authority of his father that 'A'isha said in connection with His (Allah's) words:Sahih

" And whoever is poor let him take reasonably (out of it)" that it was revealed in connection with the custodian of the property of an orphan, who is in charge of her and looks after her; In case he is poor, he is allowed to eat out of that.
