وَعَنْ جَابِرٍ - رضى الله عنه - عَنْ اَلنَّبِيِّ - صلى الله عليه وسلم -قَالَ : { إِذَا اِسْتَهَلَّ اَلْمَوْلُودُ وُرِّثَ } رَوَاهُ أَبُو دَاوُدَ , وَصَحَّحَهُ اِبْنُ حِبَّانَ 1 .1 - صحيح بطرقه وشواهده . رواه الترمذي ( 1032 ) ، وابن ماجه ( 2750 ) و ( 2751 ) ، وابن حبان ( 1223 ) ولفظه : " إذا استهل الصبي ، صلي عليه ، وورث " . وفي لفظ آخر : "لا يرث الصبي حتى يستهل صارخا" . قلت: وللحديث طريق وشواهد - يصح بها - مذكورة " بالأصل " لكن يجدر هنا التنبيه على أن : اللفظ الذي ذكره الحافظ ليس لفظ حديث جابر ، وإنما هو لفظ حديث أبي هريرة . هذا أولا . وثانيا : حديث جابر لم يروه أبو داود ، وإنما روى حديث أبي هريرة.
Narrated Jabir (RA): The Prophet (ﷺ) said: "When a new born cries (at the time of birth) (and then dies), it is treated as a hair."
